Conveyancing:- 

What is not included within our fees?

It is not our responsibility to carry out a physical inspection of the property, nor will we advise on the valuation of the property, or the suitability of your mortgage, nor any other financial arrangements. 
We will not provide advice on any survey, be involved in any negotiations on price (whether it be in relation to the property itself or fixtures, fittings and furnishings), approve or prepare any Declarations of Trust, Statutory Declarations, arrange or approve any indemnity insurance or deal with any post-completion problems. If we are required to deal with any of the above, you will be charged an additional fee which will be confirmed to you verbally or in writing at the applicable time. 

What are disbursements?

Disbursements are costs related to your matter that are payable to third parties, for example, Land Registry fees. The disbursements required differ dependent upon whether you are buying, selling, remortgaging or transferring equity and whether the property is freehold or leasehold and registered or unregistered. For example, if you are buying a leasehold property, there are certain disbursements which will be set out in the individual lease relating to the Property, upon which we will update you on the specific fees upon receipt and review of the lease from the seller's solicitors.
We handle the payment of the disbursements on your behalf to ensure a smoother process.


Stamp Duty or Land Tax (usually a purchase)


This depends on the purchase price of your property. You can find out more information about Stamp Duty and the amount you will need to pay for a property located in England by looking at the GOV.UK website on  https://www.gov.uk/stamp-duty-land-tax/residential-property-rates .


How long will my residential conveyancing transaction take?


Whilst the average conveyancing transaction takes approximately 8 to 12 weeks from the date of issue of the Contract to completion, this timeframe is for guidance only as there are numerous factors that can have an impact on the length of time that the transaction will take, and which could result in delays.

It can be quicker or slower, depending on the parties in the chain. For example, if you are selling a property with no mortgage and no chain involved, it could take 8 weeks. However, if you are buying a leasehold property, are having a mortgage and there is a chain, this can take significantly longer between 4-5 months. 


Stages of the residential conveyancing process

The precise stages involved in a residential conveyancing transaction vary according to the type of transaction and particular circumstances. 

This may include the following key stages (not an exhaustive list and not all applicable to each type of transaction):-

  • Take your instructions and provide you with our client care pack
  • Check finances are in place to fund purchase and contact lender's solicitors if needed
  • Draft contract documents
  • Receive and advise on contract documents
  • Investigate title 
  • Obtain mortgage redemption statement
  • Review the lease
  • Obtain a Leasehold Property Enquiries pack
  • Carry out searches
  • Make any necessary enquiries of seller's solicitor
  • Respond to enquiries raised by the buyer’s solicitor 
  • Draft Transfer
  • Give you advice on all documents and information received
  • Go through conditions of mortgage offer with you
  • Send documentation to you for signature
  • See you at an appointment to sign the documentation
  • Agree completion date (date from which you own the property)
  • Exchange contracts and notify you that this has happened
  • Arrange for all monies needed to be received from lender and you
  • Carry out any pre-completion searches/ checks
  • Complete the transaction
  • Deal with apportionments of ground rent and/or service charges
  • Redeem your mortgage
  • Deal with payment of Stamp Duty/Land Tax
  • Deal with application for registration at Land Registry
  • Deal with Notice of Transfer/charge and payment of fees to the management company
